It’s incredibly easy to defend that position with the evidence currently available.
The only ones potentially at risk are those doctors who do prescribe it and the patient has an adverse event related to the drug. They would be potentially liable as they went against guideline based medicine and prescribed a drug that is not shown to be efficacious for the disease in question.

You don’t think an airplane is a confined space? No one recommends wearing a mask alone in your car. Same for a park or a beach unless your are close to people not in your group.
