DOJ Inspector General Michael Horowitz testified before the House Committee on Oversight and Reform on Wednesday morning.

Horowitz revealed to lawmakers that he criminally referred former FBI Director James Comey for prosecution.

The Justice Department ultimately declined prosecution and despite Comey bragging about this, the IG indeed concluded he criminally acted.

The Washington Times reported:

Justice Department Inspector General Michael Horowitz said Wednesday that he referred ex-FBI Director James Comey for criminal prosecution.

“We are required by the [Inspector General] Act to send information that we’ve identified that could plausibly be criminal to the Department of Justice,” said Mr. Horowitz, confirming what amounted to a criminal referral.

The Justice Department ultimately decided not to prosecute Mr. Comey despite Mr. Horowitz’s team concluding he improperly leaked information to the news media. The documents leaked by Mr. Comey were sensitive, but not classified.

Comey gave portions of his classified memos to his friend-turned-lawyer-turned-unpaid-FBI-official Daniel Richman to leak to the New York Times in order to prompt a special counsel investigation into President Trump.

Horowitz released a report last month on Comey’s handling of his classified memos and said he “set a dangerous example” when he leaked his Trump memos to his friends and attorneys.

Isn't this the same referral that was declined by the DOJ?

I'm missing what's so important here.

He also referred McCabe for (basically) lying to investigators and leaking FBI info.

The reason they declined is because he can get off and the DOJ is waiting for more criminal activity to come out and hopefully then he goes to jail. The DOJ prosecutes only for a win. If they think its a tight rope on winning they will wait. DOJ does not like to lose.

Wait, this is old news--right? Yes, Horowitz referred Comey for prosecution but Barr said no for leaking.

Different set of rules people. Nothing will happen to McCabe either.

Suck it up and like it.

It's probably not for the leaking... which they declined to move forward.

More than likely the FISA affair.

As if opening this thread expecting it to be Comey indicted for FISA gate wasn't enough disappointment; you go and post that crap?

Sometimes I wonder if this move was to make McCabe think that Comey cut a deal.

The DOJ moves forward with McCabe's referral but declines comey?

If I were McCabe I might wonder what info Comey gave to the DOJ to be declined.

McCabe and Comey are definitely going to get into a lunchtime slap fight.

My money would be on Comey flipping, if either of them did. That said, I still think Comey gets the hammer on bigger charges.

If only there was someone- some kind of boss or Chief Executive who was in charge of the entire Executive (and law enforcement) branch of our government and over the entire DOJ and at whose pleasure the Attorney General served- who could make the DOJ prosecute the criminal.
