No. She inadvertently looked at him because she knew it was about to happen. The signal was likely that point in the speech and in anticipation looked at him quickly and caught herself.

Because the jury can convict of a lesser offense, then you have a Minnesota judge sentencing you on said lesser charge. Vs taking something less and getting probation or whatever.

This assumes the Judge gives instructions that include the permission to find the defendant guilty on lesser charges.

It isn’t dependent on the judge’s discretion. A jury can convict of a lesser offense if the elements of said lesser offense are “included” in the charged offense, or of an attempt of the charged offense etc.
