DHS falls under the Executive Branch.

You guys are forgetting JUST TODAY, the USSC ruled Trump can detain illegals indefinitely. Prior to that the law stated they HAD to be released.

The case had to do with ICE retainers for people getting out of jail. Whether or not ICE had to detain them within 48 hours of their prison release or they could detain them at any point after their release.
It doesn't pertain to illegal border crossings.

For all intents, it does.
Someone captured crossing the border illegally is put in jail to await trial (very high probability of flight risk, so no bail). They are tried and convicted, serve their time and then guess what they fall under?

The court case wasn't about that at all. If someone was serving a sentence for illegally entering the US, then ICE wouldn't need to be notified of their impending release.
That was the whole issue before the Court. Prisoners had ICE detainers but prison officials weren't notifying ICE when those prisoners were released. The ACLU then argued that if they weren't immediately detained, they couldn't be detained at all.
The Court simply said today that those prisoners could be detained whenever ICE finally caught up to them.
