defense attorney from Kyle Rittenhouse filed this motion of mistrial with prejudice on Mon Nov 15th. The judge has not ruled on this motion as the defense brought this up yesterday in court- this is the first time we’re seeing the motion that was filed.

I'm leaning this way too. I think the jury is on the cusp of an acquittal. The holdout jurors are hoping to make a compromise for conviction on lesser included offenses just to keep their houses from being burned down and their kids beaten up at school. Still, if true, this is a slam dunk on appeal.

I suspect a supplement to the Motion will be filed about "drop kick" man in the morning.
This will be the firewall if the jury does something retarded. The judge would undoubtedly prefer the jury acquit, but I suspect he will drop the mistrial with prejudice if they do not.

That’s very interesting. The higher quality video shows Kyle didn’t aim his weapon yet the state claims it did? Oh so that’s Brady evidence…expulcatory or evidence to show innocence. That’s pretty huge.

Well, a favorable jury verdict would be the cleanest result. If not, mistrial w/prj or dismissal would be a Just conclusion maybe even necessary, especially if there’s Brady evidence involved.

Drop kick man is the guy kicking Kyle in the face. Kyle missed him twice. Throughout the trial it was claimed that no one knew who he was. Turns out it was a lie. The DA knew who he was because he contacted the DA in an attempt to strike a bargain on other charges in exchange for testimony. The DA declined. Guy has quite the rap sheet. Also it’s believed they never informed the defense of his identity

That’s pretty damning. It is grounds to grant the motion (I don’t think the judge will) and for an ethics complaint and hearing regarding the prosecutors.
