A sitting President can either rescind the EO of a previous President, or he cannot.

A sitting President can either make immutable law without Congress, or he cannot.

It's as simple as that.

If he does this, he establishes a monarchy. Trump can go hog wild with EOs and tell SCOTUS to frick themselves.

He may want to avoid the Court being perceived as political, but he's already on thin ice after his last second Obamacare flip.

List heard the CBS reporter say that Trump needs to explain his opposition to DACA and he could rescind it.

The Constitution? Must be in one of the non-existent footnotes.

Administrative Procedures Act?

Notwithstanding DACA is illegal on its face (this, any regs/rules would be null), that would be a fricking unconstitutional infringement on separation of powers.

This is a chance for the Judiciary to limit the overreach the Executive Branch has been using for too many years.
Even with Roberts, this should be a win.

What can be done by EO can obviously be undone by EO, can it not? I mean, how could it be any simpler than that?

If a succeeding president cannot rescind EOs of his predecessor, why do we need the legislative branch? The president can simply make law by decree.

The vote SHOULD be 9-0, but you know Kagan, RBG, and the Wise Latina will vote to uphold BHO's EO. Breyer is 50/50, and Roberts is the wild card.
