I didn't say that an allowance for religious scruples should only be made if they are a good worker. However, if they are a good worker in every other respect, then making an allowance for something like this shouldn't be a problem. My comment wasn't about the existence of an accommodation, but the impact of the accommodation based on the employee's performance.

As someone who has been a people manager, there was a lot I was willing to tolerate for someone who worked hard and didn't abuse my generosity or the flexibility of the company.

Yes. Sometimes I had to go to another pharmacy based on availability. I didn’t even die.

So if my company says you have to work on your sabbath or don’t work here at all, that’s going to be perfectly fine?

Pretty sure we still have what’s called religious freedom.

As an entity in the business of selling prescription medication, please explain why CVS should be forced to turn away its customers in order to satisfy one employee’s weird misinterpretation of a religious text?

100%, it should be, for a private employer in a free market.

Of course, the federal government cannot seem to keep his filthy hands off of anything, so we have the Equal Employment Opportunity Act of 1972.

the first amendment does not apply to employment by private companies.

The useless Warren and Berger courts expanded the Commerce Clause to give Congress the authority to regulate this sort of thing.

Thanks to them, we are no longer a country with a Constitutionally-limited federal government.

This is what I was getting at without remembering the name at first.

So basically they say you should accommodate strongly held religious beliefs.

Among other things, yes.

Basically, SCOTUS has (erroneously) decided that the Commerce Clause gives Congress the authority to do … pretty much any fricking thing that Congress wants to do.

If a phlebotomist refused to do blood draws being used for transfusions on patients because she’s a Jehovah then she can be fired.
