The Election clause of the constitution says only state and Congress can make that determination. The action itself isn't illegal it just can't come from the Executive Branch.

Congress can, and should.
I don't understand after the ruling, they just don't do what the judge said and have Congress pass it. Republicans control both houses, and it would put Democratic Senators on record for voting against it.

I haven't read the reasons for her decision, but it's not a leftist position to say that an Executive Order is not the means to regulate elections.
