InterDigital Inc on Monday said Huawei Technologies Co Ltd filed a lawsuit against it in China, alleging the U.S. technology firm had not licensed its intellectual property on fair terms.
The lawsuit, filed on Jan 2. in the Shenzhen Intermediate People’s Court, alleged InterDigital violated an obligation to license patents that are essential to 3G, 4G and 5G wireless telecommunication standards on fair, reasonable and non-discriminatory terms, InterDigital said in a regulatory filing.

Huawei asked the court to determine a royalty rate that would apply to its wireless products from 2019 to 2023, Wilmington, Delaware-based InterDigital said.
A Huawei spokesman did not immediately respond to a request for comment.

The fricking balls of any Chinese company claiming copyright infringement by anyone.

They may win in a Chinese court but let’s see how they enforce it.

I don’t think the international kidnapping of execs will solve this one no matter what China thinks.

I know the outcome already... Chinese court finds in favor of Chinese company and authorizes said company to steal the technology because it was not licensed on "fair terms"...

This is a trojan horse for the US. Once they have a legal finding in their own country. It will open the floodgate for US fims to use that ruling against the chinese companies.

This is EXACTLY why China will put in more IP protection like Trump wants. It will help Chinese companies when they develop technology.

We are in effect helping those Chinese technology companies as we punish Americans with tariffs to help large US companies wanting to do business in China.

Huawei does have a lot of 5G patents and they are going to want them protected. I am quite sure this powerful Chinese company agrees with Trump on the IP.

Remember the Chinese owns companies like Syngenta now too. Lots of patents there they will want protected.

I don't care but nobody should be surprised as we see more original technology come out of China as they strengthen, partially at our request, their IP laws.

Soon---maybe even this week or next since the talks are going on--the Chinese will point out some new IP protections and will liberalize their foreign investment criteria and Trump will declare victory and end the trade war. Poster after poster here will declare China bent their knee. The reality will be of little notice to the average American except they may lose their job as companies like Tesla and Boeing and Apple expand their presence in China with the new found IP protections.

They are spying on you now through your TV. That is what you said last week I believe.

Strange how I am the "commie bastard" yet I am the one AGAINST pushing them to accommodate more American companies manufacturing in China and you are for it.

Want to protect your IP??? Quit selling your products in China and quit building plants there.

Anyone who understands the multiple ways in which the chicoms have stolen American companies’ innovation will look at this and understand how laughably hypocritical this is. The chicoms are losers who can’t come up with good ideas of their own.

Well like everything else when their is a profit motive you can expect people to figure out how to do it.

Stronger IP protection will allow all companies in China to invest in developing in new technology and to profit from it.

Instead of looking inside for favorite American brand of something and seeing a "made in China" sticker don't be surprised to one day find your favorite brand or technology is from a Chinese company. Remember that the tariff war of 2018 contributed to making that possible.

Amazing how far some posters here will go to support Trump on this tariff war just to benefit a small number of very large US companies who need more IP protection in China and need to see less stringent foreign investment laws in China.

Motorola has lost more IP than almost any other US company in China. I saw an interview with the CEO last week. They had over 17,000 employees there and introduced most of the cities there to their radio technology to only see the Chinese steal it. Now they still do some business there but have moved out in a big way and employ less than 200 people in China. That is the lesson these US companies should learn.

How much should we all pay to try to do the work of the Boeings and Apples of the world in China???? Zero IMHO. Motorola bit the bullet---they can too.

In order to understand whats happening, this part seems to be the most important portion of the article.

I'm guessing that Huawei isn't liking the proposed terms of the new licensing agreement.

None of you understand what is going on here. Interdigital, the U.S. company, owns the patents in question. The patents are, apparently Standard Essential Patents (SEPs). That means they are patents that must be copied in order to comply with industry standards in 3G, 4G, and 5G technology. When a company owns an SEP, they have an obligation to license those patents on fair and non-discriminatory terms.

The Chinese company is practicing the patented technology, and admits that it is...they are just complaining that the US company is not giving them fair licensing terms and they are asking a court of competent jurisdiction to set those terms.
