The Judge ordered Mueller to make public the fact that the first 302 Mueller provided to the court appears to be falsified - i.e. made to look like a draft - not a true 302.

Pursuant to the Court’s Minute Order dated today, the government hereby files two redacted versions of the FD-302 report summarizing the FBI’s interview of the defendant on January 24, 2017.
See Attachment. The content of both versions of the report is identical, except that the first version, which was digitally signed and certified in February 2017, inadvertently contained a header labeled “DRAFT DOCUMENT/DELIBERATIVE MATERIAL.” Once that error was recognized, the header was removed and a corrected version, omitting only the header, was re-signed and re-certified in May 2017. Flynn claimed that he never asked the Russians to not escalate following new U.S. sanctions and that he never asked them to vote a certain way at the U.N. According to original redacted 302s.

Mueller has already filed what he has identified to the court as the original 302 that was drafted right after Flynn's interview. But, Mueller redacted part of the document and requested that even the redacted 302 be filed it under seal, meaning that even the redacted document would not be available in the court record.
According to the order, the judge approved the redactions that Mueller proposed to the 302, but has rejected Mueller's request to file the document under seal.
That means that the document, as redacted, will be available to the public in the court record.

This was agents sent by Comey. The Mueller investigation reviewed the reports and stacked it up against what they knew and found that Flynn wasn’t truthful with FBI agents.

What are the judges options? I don’t think he can throw out the charges, as a guilty plea has been accepted. He could possibly urge the defendant to withdraw his plea. He could sentence him to no jail time and refer the Agents and prosecutors to the Office of Professional Responsibility. Will be interesting.
