They weren’t “illegal.” The accurate part of your statement is that, whatever the number, they were admitted.

Republicans were actively involved in maintaining the state of immigration law both during Trump’s first term and during the 2021-2024 timeframe. US immigration law during that time, and even now, provides that anyone who applies for asylum will be admitted into the country and given a status that allows them to work. They are given social security numbers and they pay payroll and income taxes. Their legal admission status continues until their asylum claim is heard by an immigration judge. Through Trump’s first term and between 2021-2024, the hearing delay was greater than a year, often longer.

As for OP’s suggestion that we need to suspend habeas corpus, that would mean that anyone can be jailed for no reason and you can not sue for your own release from illegal detention. No thanks.

The “invasion” was not an invasion at all. It was the asylum loophole that Republicans allowed and actively protected. Remember the “bipartisan boarder bill?” That would have closed the loophole and hired more judges to speed up the adjudication process. Republican killed it so they could continue to insist that immigration was out of control. They were directly involved.

The real kicker is that now that the Republicans control both houses of Congress and the presidency there has not been a single legislative bill to change the law. None. We have executive orders that don’t change the law and aggressive actions that don’t change the law, but the asylum loophole is still law. Republicans are protecting this law because they think they can use it for political purposes in the future.
