Yeah I don't see a way around it. If race isn't a factor, there are no D districts in Alabama.

I was waiting for cases to be brought in these redistricting battles along the lines of Black race-based exclusionism.

If it can be shown that race was a deciding factor in the redistricting, the three judge panel ruling will be upheld. That seems like a high bar. Outcome will be contingent on the arguments, and proof that race was the basis for the new districts.

I don't see this as a slam dunk for either side. But it is an obvious next step in the legal process, and was predictable. Hopefully the basis for Alabama redistricting was sound in other ways. If so, this will be overturned.

I don't understand why they chose to re-enter this exact map instead of just drawing a new one, with a new record that doesn't implicate race as a factor.

That's the obvious next step here, almost regardless of what SCOTUS does in this case.

Being lazy and not doing it right the first time can very well cost them the 2026 change now.
