Open fields doctrine

I just saw the Pennsylvania overturned the open fields doctrine. Does anyone know anything about the case in Louisiana? A google search shows it’s till in the courts but originally filed back

Yes the Louisiana open fields doctrine lawsuit is still in the lower courts. It’s a long process. The Pennsylvania case was filed in 2021 and has just now been decided.

Open fields allows your hunting property to be a government surveillance site. It’s one of the things that needs to be overturned

The second this goes, game wardens are no longer driving across my property in Iberville. Why? Because I no longer see the black guy who was good at his job and only see the whiney white guys.

I disagree baw. Shouldn’t be open season to bait and shoot over the limit because it is on private land. Taking over the limit and baiting affects everyone who hunts. Animals aren’t yours, they are the states. Game wardens should have free range otherwise private land owners kill everything.

I don’t feel like it would lead to more unlawful behavior. I think most People who follow game laws don’t follow game laws in fear of being cited by a game warden. And I don’t think people who break game laws, are deterred by the threat of a game warden.

Private property rights are the backbone of our freedom in America. And I don’t think you need to worry about wildlife populations being over hunted if the open fields doctrine is overturned in Louisiana. It is already illegal in several states, including Mississippi and Tennessee, and they have game populations greater than Louisiana.

The government should be able to watch your wife and daughters shower and change clothes just to ensure a crime isn’t committed in you home

States do have authority over actions of state LE.
However, setting up cameras on private property, unannounced and without evidence searches of people's private property without a warrant or consent are violations of the 4th Amendment and should trump state laws.

Several states have verbiage within their constitution that make an open fields case plausible.
Louisiana is one of them.
IJ also recently lost an open fields case in Alabama that it plans to appeal.
If anybody wants somebody to hate for this, it’s Justice Holmes and his lazy arse.

I have been hunting for nearly 53 years and people who break game laws are going to do so no matter what and those of us who do not break game laws do not need policing. I have hunted ducks and geese in every flyway in the US as well as Dove and upland gamebirds where they exist in huntable populations. I have hunted public land and private places including some pretty swanky waterfowl clubs and in my experience there is no rhyme or reason to it, the poorest white trash shooting a COE in Lake in Georgia is as likely to fall in either group as the wealthy individual with tons of money tied up in land and equipment and makes huge donations to conservation groups is just as likely to fall into either camp. The number of game wardens in any state is such that there is almost no chance of anyone being caught breaking the law by a game warden unless the idiot is dumber than a sack of hammers. The damn well ought not be allowed to enter private property without probable cause just like any other policeman.

In the world of waterfowl hunting it is illegal as hell to add grain to water but encouraged to add water to grain.....and not adding water for an agricultural reason like rice but intentionally flooding corn and wheat fields to attract and hold ducks and geese.

Get a search warrant first just like you need to enter and search my home. Otherwise, keep out.
