Another gun question.

If I bring mine to spring break (FL) and leave it in my truck, could they somehow say it's in my possession if I'm drunk in the condo or on the beach?

What about if I leave it in my duffle bag in the condo? If we're drinking in the condo and cops come am I asking for trouble?

I had this problem in Miami. I fought it and got it thrown out. They had no samples or pictures of what was in my red cup. I was just sitting there with my wife and friends. I'm 36 fricking years old and was only two beers in. You may want to talk to an attorney. I'm glad I did.

I thought they were supposed to ask?

No. There is no requirements for an officer to ask anything of that kind. If it is just a traffic stop, if you ask, people tend to say yes and immediately reach for it. No ill intent meant but it can get a little scary.

If you have a CCW, it is very good courtesy to tell the LEO that you have it and where the gun is located. This is not a requirement but, it certainly is appreciated by an officer.

Just the other day, I was doing my job (Parole Officer) doing a home inspection for a transfer. I asked a woman if there were any guns in the home and she immediately reached for her piece. She had a CCW and a gun in her handbag. Before she got it out, I stopped her and thanked her for her honesty.

That might have been a criminal open container citation. Is there a Court date? If so, that cop really screwed you over.

I have always told them to avoid a misunderstanding. Usually they just say OK.
Sometimes the take it out and dump the bullets out onto the seat. I had one where I refused to get my insurance papers out because I had to reach over a shotgun, rifle, and my hunting pistol. After refusing several times I agreed to get it from the passangers side. He was cool. By this time he was laughing at me and only gave me a warning. His comment "Every redneck I pull over has loaded guns. you get use to it. State Trooper.

And also if you have a CC permit, they will see this once they pull up your driver's license information. It's best to notify upfront. Most officers will appreciate the honesty and sometimes let you go. I've had 3 LE members let me go for disclosing the information. They knew I wasn't a threat and appreciated the courtesy.
Just wanted to add one more courtesy gesture. If you're pulled over at night, turn on your interior light. Makes the officer feel much more comfortable.

Good idea. I never thought about that. I have finally learned to slow down a little.

Solid advice!

Not eye, said the blind man.

This puppy is on my horizon in the future so I doubt I'll be grandma driving. Then again, I'm usually respectable of the speed limit, I just accelerate quickly. 556hp will make that process a bit quicker.

I have been asked only during a registration checkpoint. I answer yes, and show the CC permit.

I will never just tell them in New Orleans. it is crazy that the NOPD still trains their cops to take your gun if you do not have a bill of sale with you. Some won't do this, but I know some that will.
