Boating question

Is it legal for sheriff department cops on a boat to stop you and ask for your paperwork on your watercraft for no apparent reason. I was idling through a no wake zone the other day on my jet ski and sure enough here comes two cops on a boat wanting to see my paperwork. I hadn't done anything wrong! It ticked my off at first, but i guess these guys were just doing their job.

Yea. As long as you're legal there's nothing to worry about.

Nothing wrong with what Sheriff Dept did. They have every right to do so.

Absolutely. So does the Coast Guard.

Just stay away from these guys:

Very debatable in light of the fourth amendment, but I will save the full discussion for another day. Unfortunately, out right to be free of unreasonable search and seizure has slowly eroded away due to people not standing up to the government on the definition of reasonable. We will allow any intrusion in the name of "safety". rant over.

they have every right to do so. IMO its no different that a DWI check point or and insurance check point. they are trying to keep the waters safe and as long as you're legal you should comply and want them out there doing their job

I agree with this part, but

I disagree with that, just as I do with all types of checkpoints and the like.
But I digress.

You, sir, are what I'm talking about. I don't have the time today...but I promise I'll give a full legal discussion at a later date.
Edit: tigerbait--aren't you the one who wished me dead because I drove buzzed one night? If not carry on...

This wasn't a checkpoint, the cops were riding down the river stopping people left and right for doing nothing wrong. If a cop sees me on the road, he has to have a reason to stop me. I don't see how this is any different.

I dont mind getting stopped, I'd rather them leave me alone, but I understand the point.

absolutely not...I would never say that

most definitely. No different than registration for your car and water patrol or LDWF seems to need no reason at all to make a stop and check licenses, registration and anything else they want.

The answer is yes, they can check you at any time on the water.
But I don't think they should be able to.

It's different because boating is more dangerous than driving a car, and most are far less experienced at driving watercraft than cars/trucks. Every activity on water is inherently more dangerous because its taking place on water. We are not equipped with gills. If there were no random stops by police, coast guard, and W&F there would be a lot more tragic boating accidents.
anyhow, be safe out there

I can understand how some views can be negative toward check points, water craft safety checks, etc.
However, I think the opinions pretty much focus on the word "unreasonable".
When the constitution was developed, I seriously doubt the authors had the fore sight to include, "we don't want the government performing safety checks on high speed motor vehicles and water craft."
I actually have mixed feelings on this myself. But truthfully, I feel much better knowing there are safety checks ensuring others have taken the necessary precautions that I have taken. I've actually been ticketed for forgetting my registration in my boat. My bad. I paid the fine and learned a lesson. I hardly found the experience unreasonable. But again, that's just my point of view.
