Yeah. They gloss over the other factors cited in the ruling. I don’t really know why. But, you are right, the APA part is all that was needed for the judge to grant the injunction. He piled on some more good stuff, too, though.

It was put there because handguns were slated to be included in the NFA.


Well, the whole damned thing is an affront to God, IMO, who entrusted me with the gift of life and presumably expects me to safeguard it.

That said, I don't like some of the disingenuous arguments others use to defend my rights. It doesn't matter who might want a pistol brace or how great they are, nor does it matter what "AR" stands for.

It doesn't matter if "features" are "cosmetic." If I buy a rifle with a bayonet lug, it's so that I can use that lug for its intended purpose- which is not very "cosmetic."

We should argue very little beyond "because I want it."

Things like this make ya wonder if it's all a big game...

panic the gun owners, make money with the gun and ammo sales. Collect more money from the anti gunners, panic the gun owners again.

I mean, 2nd Amendment and NFA issues aside, the ATF has been dicking around with the brace issue for a decade now. You'd think they have a competent legal staff capable of following correct procedure, regardless of your position on the actual subject. It's almost like they KNEW this would get shot down on procedure alone... that way, nobody gets put on the spot, nobody has to argue messy Constitutional ideas that could become a flashpoint to something bigger. Everyone wins. The government can say "they tried to do something", the brace owners keep their guns, the industry gets a panic buy season, rinse and repeat.

And now it’s on the gun grabber registry, and you can’t let anyone borrow it, and you can no longer keep it loaded in your truck going down the highway, and you have to write the ATF in advance to get permission to take it to another state to go hog hunting.

I live on thr Alabama/Tennesse state line and shoot deer at night with it in both states so I already have a letter that allows me to transport it into my neighboring county. If I feel like there are any advantages to it being a pistol I can just buy a pistol. Much prefer having a short barreled rifle. As far as being on the registry I have had multiple items on the registry for 20 years.
The sheriffs in both counties/states I own land in are very accommodating with anything I have ever asked of them. Guys at my local ATF field office in Huntsville have also been super easy to deal with. I only carry it into another state in the summer months so my form lists April to August for transportation dates.

Not me...I got 11 free SBRs that I wanted anyway...like I knew I would Its stupid in the first place but now I don't have to shell out 2200 bucks for the stupidity.

just so we're all aware, this nationwide injunction is only temporary. the enforcement of the rule has been put on hold until the end of the court proceedings.
