NO NO and NO! Recording a conversation is never illegal unless you have that expressly discussed. Now, a court "may" rule it inadmissible, but you would always rather have it than not have it.

So if any of you get anything out of this thread, don't ever not record the conversation worrying about it being illegal, it can always be destroyed, but not recreated out of things air.

Full disclosure....I'm recording this now

I don't understand why DIL isn't mad as F at MIL, in addition to the doctor.

NO ONE outside of MIL should know about that after the doctor spilled the beans.

Assuming the friend did nothing to prompt the comment, it's a clear HIPAA violation with the MIL as a witness if the doctor knew of the condition (without a need to know) and shared the info with a third person without a need to know.

I agree that the MIL is an a-hole, I'm just saying that she can't be sued for a HIPAA violation because she isn't a covered entity. Only covered entities (hospitals, docs, hospital employees, and other people who have access to privileged info) can be sued for violating a patients privacy rights.

One time our gp called me to rat my husband out ab his crappy Blood work.

Did he try to sue her? NO.

why couldn't the friend just explain the situation to the mil and keep things under wraps until the husband came home? Who knows...the mother in law could have been a good source of comfort.

People are weighing down the legal systems with so much garbage.
So the doctor messed up. It's already done? Does she want money for her anger? Will that make it better?

To reiterate. The doctor told your friend the private information in front of her mother in law, which she wants to sue for.

What your friend is most upset about is the fact that the information got out to others VIA the MOTHER IN LAW.

Why is your friend blaming the doctor for her heartache when her mother in law is the one who spread it around town?

The doctor is a professional and this is part of an agreement between the doctor/patient. its pretty simple. MIL is a count too though
