2nd degree murder would make sense with NOPD going with road rage. I still have my doubts of it being road rage vs robbery gone wrong.

First degree murder involves a premeditated killing. In other words, the killer made a plan to kill the victim and then carried that plan out.
Second degree murder does not require premeditation, however. Instead, there are three typical situations that can constitute second degree murder:
A killing done impulsively without premeditation, but with malice aforethought
A killing that results from an act intended to cause serious bodily harm
A killing that results from an act that demonstrates the perpetrators depraved indifference to human life - See more at: LINK

Man it is scary how crazy people are. Apparently the people in the impala were acquaintances of Will. Will probably felt pretty safe with them around and two other people in the car with him...in PUBLIC. I'm definitely going to keep my temper in check on the road going forward.

By definition:
Second Degree Murder: Definition. Second-degree murder is ordinarily defined as: 1) an intentional killing that is not premeditated or planned, nor committed in a reasonable "heat of passion"; or 2) a killing caused by dangerous conduct and the offender's obvious lack of concern for human life.
Him simply saying "I'm gonna fricking kill you" would qualify this as 2nd degree murder. He intentionally meant to kill him without it being premediated

My bad. Missed the word Will in your post.

That is what i said above, the hummer hit will and it caused him to hit the impala. it could have been a case of boxing him in to try and rob him
Idk if it was confirmed. But I thought I heard on the news that the impala was part of will smith's party

It clearly states in try article that the impala had acquaintances of will in it.

I just realized I didn't capitalize Will. That made it hard to read.

Louisiana law does not use the term "premeditated." They use "specific intent". For it to be 1st degree murder, it would have to have been during the course of certain other felonies or other specific parameters. If it's just a homicide like this appears to be, then 2nd degree is the appropriate charge.

The first articles I read on it didn't say anything about Will knowing the people in the impala.

That just means there was no premeditation.
Thats what I mean. No robbery or carjacking. Two guys probably mouthing back and forth. The shooter felt threatened or escalated quickly? I'm wording it poorly.
There just must be more, because that is a quick 2nd degree charge in what is a high profile murder. Must be something pretty damned obvious to throw that out there so soon.

I would imagine they have a few hardcore saints fans in Angola

Premeditation is not the difference in LA between 1st and 2nd degree. There must be other factors for 1st degree in LA- multiple murder, murder of a LEO, murder of political official, murder of child, murder during commission of felony, etc.

Just imagine what hell his wife went through sitting there shot next to her dead husband. Man that's rough.
Didn't they have a new reality show come out?

Yea that has to be hell and for her to be shot as well because some low rent frick 1. shot someone for no fricking reason, 2 shot another innocent party because the frick sucks at aiming.
Then you have PT sitting in the backseat has his friend is killed and his friends wife is shot as well.

How do you shoot someone in their own car and then claim self defense?

This whole incident is ridiculous and just another incident painting NO in a horrible light.
