yeah, I think if he got out with the gun brandished he is done. if he pulled it out after smith got hostile or tried to swing at him like we heard, then he gets off.

I would say it was sort of abrupt... but smith was clearly following too close.

if the smith's weren't sauced as some think, would it not behoove the prosecution to have itemized receipts from their day out. you can get them after the fact. I have done so plenty of times for expense reports.
