Smith was first shot while standing outside his vehicle facing away from it, talking to his wife. it is just as plausible he was going to sit down, perhaps to call in the vehicular accident.

ETA: his weapon was also inside "a case".

fortunately is he here to tell us these things. So we believe him when he says he had a gun and shot, but we don't believe when he says WS had a gun?

So why do you think Hayes waited until then to shoot him? IF Smith was planning on making a non violent move, such as calling in the accident? Why did Hayes show restraint up until that point, and then all of a sudden decide to shoot Smith?



btw, his door was open, and his back was to his opened door when he was first shot. He was in the entry way. Rodrgiue just stated this during her closing.

Good, so you admit that Smith was not facing his vehicle. That means he couldn't possibly have been reaching for his weapon.

There is no evidence supporting that WS had a gun. None whatsoever. Matter of fact it was testified that he didn't have a gun bc it was found in a case between the seat and console.
