But he admits to shooting smith right?
We all know that.
What was never established was when Hayes got his gun or if he exited his vehicle with his gun.
It was not established by the prosecution that Smith wasn't going for his gone.
No one that testified up to this point has actually said that they seen Hayes with a gun.

No one has said that they saw Hayes go back to his vehicle to retrieve his gun either

Hayes made the statement himself , and it was played on the 911 call. You may not believe that's established, but the jury does.

In Ross's testimony: Ross said he heard Hayes admit to getting out of his car with the gun.

Agreed.
IMO it was never established if he got out with a gun or if he retreated to retrieve gun.
But witness statements of Smith and Hayes hand fighting and Racquel getting between the two gives me the impression that Hayes didn't have a gun that was visible.

People think they can draw a conclusion from reading 20 tweets. I'm guilty of it too.
It's pure insanity.

Also tLSU, I been meaning to catch you. For a while I was using one of your Nola pics on my FB or Twitter or something similar. You have several very unique yet awesome shots.... don't Think I have any displayed now but just wanted to run it by you and see if you are okay with that.
Also if you have any new ones or even old ones I haven't seen or seen in a while, I always liked looking through your pics. You should try and make some money if there is any and the market isn't saturated.

Now, if he/they retreated and Hayes went after him/them, that's where it gets even more funky. At what point has Hayes lost his defense due to the retreat removing the threat he initially perceived? Is it measured by distance or time?
Finding his casing inside the MB serves to bolster the prosecutions case........

First off, it should be "they saw."
Secondly, there was testimony stating that Hayes said this.
No one testified to seeing Hayes with a gun.

But no witness said that they saw Hayes with the gun. That is the only point that I am making. If the prosecution would have had a witness saying Hayes had a gun when he exited his vehicle it would have been hammered and brought up by more than the 911 call.
At this point we can only assume that it was Hayes talking on the 911 tape. He didn't make the call a third party did but is the same person who said he didn't see the shooting either.

No one has disputed that it wasn't Hayes' voice.
