We all know that.

What was never established was when Hayes got his gun or if he exited his vehicle with his gun.

It was not established by the prosecution that Smith wasn't going for his gone.

No one that testified up to this point has actually said that they seen Hayes with a gun.

Hayes made the statement himself , and it was played on the 911 call. You may not believe that's established, but the jury does.

In Ross's testimony: Ross said he heard Hayes admit to getting out of his car with the gun.

Agreed.

IMO it was never established if he got out with a gun or if he retreated to retrieve gun.

But witness statements of Smith and Hayes hand fighting and Racquel getting between the two gives me the impression that Hayes didn't have a gun that was visible.

First off, it should be "they saw."

Secondly, there was testimony stating that Hayes said this.

No one testified to seeing Hayes with a gun.

But no witness said that they saw Hayes with the gun. That is the only point that I am making. If the prosecution would have had a witness saying Hayes had a gun when he exited his vehicle it would have been hammered and brought up by more than the 911 call.

At this point we can only assume that it was Hayes talking on the 911 tape. He didn't make the call a third party did but is the same person who said he didn't see the shooting either.
