Your position is clear here.
I think it is clear that Hernandez is the one who escalated all this shite, along with Smith to an extent. Had they simply gotten out and exchanged info, I doubt this all happens.

That's not true. Hayes could have just followed Smith and called the cops. He didn't have to do what he did.
Plus there is no concrete evidence that Smith hit Hayes.
