John Simerman ?@johnsimerman 1m1 minute ago
Fuller: "And you don't know if Mr. Hernandez told Mr. Hayes, 'Ima f-in kill you, n-word.'"
Brueggeman: "Mr. Hernandez never told me that."

Ramon Antonio Vargas ?@RVargasAdvocate 1m1 minute ago
Brueggeman concedes that he can't say Richard Hernandez didn't threaten to kill Hayes/O'Neal or insult their race.

JF: When did you apply for search warrant for video at Barcadia?
BB: Just a call again. Not all places require a warrant.

Danny Monteverde ?@DCMonteverde 1m1 minute ago
JF: when did you apply for search warrant for video at Sake Cafe?
BB: No search warrant. Just called them.

Danny Monteverde ?@DCMonteverde 45s46 seconds ago
BB on not getting warrant for video: "Most places, they give it (surveillance video) to us because we're law enforcement"

John Simerman ?@johnsimerman 1m1 minute ago
No search warrants for video from Sake Cafe, Barcadia, Ruth's Chris, Brueggeman says. Just requests. Doesn't know dates.

I'm not sure he walks, but Fuller is making this very interesting. It's not a slam dunk like it seemed earlier.

Fuller making a compelling argument for a botched investigation and rush to judgment by the NOPD in this case.

Caresse Jackman ?@CaresseJ 1m1 minute ago
Fuller asking detective now about accident reconstruction expert.

Ramon Antonio Vargas ?@RVargasAdvocate 2m2 minutes ago
J. Fuller asking if Brueggeman remembers when the data recorder from Hayes' Hummer was recover. Brueggeman says that was done by ...
Ramon Antonio Vargas ?@RVargasAdvocate 2m2 minutes ago
... someone else.

Ramon Antonio Vargas ?@RVargasAdvocate 26s27 seconds ago
J. Fuller again brings up gunpowder residue test done Will Smith's body. Mentions a toxicology report.

Ramon Antonio Vargas ?@RVargasAdvocate 4s5 seconds ago
J. Fuller: Tell members of the jury whether, before Hayes was indicted, the grand jury had the results of the tox test.

Ramon Antonio Vargas ?@RVargasAdvocate 43s44 seconds ago
Brueggeman: I don't believe they had it at the time.

John Simerman ?@johnsimerman 28s28 seconds ago
Jury looking quite alert as Fuller cross-examines lead detective, leaning forward in seats.

Caresse Jackman ?@CaresseJ now
Fuller: NOT A SINGLE PERSON STATED TO YOU THAT MR. HAYES SEEMED INTOXICATED, HIGH OR ANYTHING.
Det: Nobody from scene, no.

Caresse Jackman ?@CaresseJ 53s54 seconds ago
Fuller asking why toxicology tests are important in a situation like this one.

Ramon Antonio Vargas ?@RVargasAdvocate 1m1 minute ago
Tox test, we know, showed Smith was intoxicated. Fuller has Brueggeman say that a tox test could hint at a person's frame of ...

Ramon Antonio Vargas ?@RVargasAdvocate 1m1 minute ago
... mind, among other things.

Ramon Antonio Vargas ?@RVargasAdvocate 1m1 minute ago
Fuller: Did anyone tell you say Hayes seemed inebriated? Brueggeman: No.

Ramon Antonio Vargas ?@RVargasAdvocate 51s52 seconds ago
J. Fuller: Did you smell alcohol on Hayes? Brueggeman says he could smell it.

Ramon Antonio Vargas ?@RVargasAdvocate 31s31 seconds ago
Hayes denies drinking the day of Smith was shot, btw.

But why beat up the PD for that?? Isn't that the call of the DA office??

To elaborate, Brueggeman said he could smell alcohol on Hayes during questioning after the shooting. But Hayes denies it. No test shows...

Ramon Antonio Vargas ?@RVargasAdvocate 8s8 seconds ago
... Hayes was, that I am aware of.

Why didn't the NOPD conduct a blood test or breath test on Hayes? I mean he was involved in a deadly car accident which technically would have required a toxicology report on Hayes

It goes to the rush to judgment by the DA to prosecute Hayes without sufficient evidence at the time. Shoddy work by all involved.

NEver been to trial so excuse the question if dumb: So do they just bring up the shoddy work EVERY TIME they get the chance even though it doesn't necessarily relate to THAT witness (ie lead det didn't rush it to the grand jury, DA office did)

Ramon Antonio Vargas ?@RVargasAdvocate 3m3 minutes ago
J. Fuller: Did you ask Hayes submit to urine, blood, breath exam? Brueggeman: No.

Ramon Antonio Vargas ?@RVargasAdvocate 3m3 minutes ago
Brueggeman said he didn't think he needed to based on his impression of Hayes' sobriety.

Ramon Antonio Vargas ?@RVargasAdvocate 4m4 minutes ago
Brueggeman said that despite saying a little while ago that he could smell remnants of an alcoholic beverage on Hayes.

Ramon Antonio Vargas ?@RVargasAdvocate 3m3 minutes ago
J. Fuller asks Brueggeman whether he is aware if Hayes told anyone that Will Smith threw a cup at him. Brueggeman says no.

John Simerman ?@johnsimerman 3m3 minutes ago
Brueggeman says they didn't test Hayes' blood or breath for alcohol based on impression he was sober.

John Simerman ?@johnsimerman 6m6 minutes ago
First we've heard Cardell Hayes had been drinking, according to Brueggeman.

Caresse Jackman ?@CaresseJ 9m9 minutes ago
Fuller: On that particular video you can clearly see his state of mind.
Det: Yes.

Caresse Jackman ?@CaresseJ 10m10 minutes ago
Fuller: NOT A SINGLE PERSON STATED TO YOU THAT MR. HAYES SEEMED INTOXICATED, HIGH OR ANYTHING.

He said he did smell alcohol but at the same time he was unaware that Smith threw a cup of alcohol on Hayes.

I do remember tigress calling the judge by her first name and saying that they are friends since 1st grade.

I don't believe I said friends since first grade. I said I've known her since first grade.

THERE IS A DIFFERENCE.

I also said we went to the same school grade 1 through grade 12. Furthermore, I said we had boyfriends that were best friends and we hadn't socialized since our college days.

Yes, I called her by her first name as anyone would do knowing someone for close to 50 years. It's not disrespectful to call someone by their first name in this case as I grew up in the same neighborhood as she did and attended the same Catholic schools as she did until college, where she attended Loyola and I attended LSU.
