It’s not. If you use out of state property in a state that has a use tax, you need to pay a use tax on it. I do this as part of my job.

His personal use or his business use. If the item is used in Tennessee more than in Montana (was, and likely never in Montana), then he owes use taxes on the item.

Got it. And I’m guessing they are depending on neighbors to rat on each other when it comes to general personal use.
Well until they put in camera systems they have in CO where they’ll just show up at front doors using the police state.

Assuming he intentionally got arrested for this for the clicks, $39k in the grand scheme of his revenue is pennies and he would have as said already been notified multiple times before the police just showed up.
