Pretty sure that as a commercial driver you have an obligation not to run into shite whether it’s there properly or not. Driver definitely has some responsibility

Unless he should have been working at a higher height, he is probably the only one without fault.
The "flagger" should have made the truck change lanes or have the truck stop and wait until the bucket guy could clear.
The 3 dudes sitting in the a/c should have been doing something other than getting paid to sit.
The truck driver should have been able to gauge that he wouldn't clear the bucket or at least travel through at a slower speed if he was not sure.

If something is in your lane and is unavoidable (you cannot move out of the way due to other cars next to you and you cannot stop in time), then being a commercial driver has nothing to do with it being your fault.
