So, he wasn't riding the horse on the street in traffic. That's the distinguishing factor. If you're riding a bicycle on the street in traffic, you can most certainly be charged with and convicted of a DWI.

there was a guy fishing in a jon boat in the Red River, twenty or so years ago, that was anchored not too far offshore near downtown SHV, he set a few lines out and was enjoying a few brewskis and decided to take a nap, some concerned citizen saw him sprawled in the boat, blissfully enjoying his day off, and called 911 thinking he was dead I guess, cops arrive, see the beer, sir have you been drinking? don't know how the case played out but he was charged with DUI

No that was not the distinction. They spelled out the reason he couldn't be arrested was because he was because he was on the horse.

They gave him a drunk in public charge which means he was deemed close enough to Hwy 16.


Seriously, the law was deemed not to cover bicycles because it was too vague. By the way the law is written you could arrest someone crossing the street with a walker because they are using it as a means of conveyance and it has wheels.

Go to Shiner, Texas. The gas station around the corner from the brewery has Shiner kegs in the wall (self serve) and a “Biergarten”. The Biergarten is some old fold out chairs sitting around some older cable spools under an old as shite, rusty awning.

I put away two pints once while the truck was filling up with the wife and kids sitting in the seats.

Louisiana has a DUI law that prohibits the operation of a motor vehicle, aircraft, watercraft, vessel, or other means of conveyance while intoxicated. The issue relating to bicycles came to a head in 2000 when the Louisiana Supreme Court decided the criminal case of State v. Carr, 761 So.2d 1271 (2000). In Carr, the Court held that the DUI law did not apply to a bicycle because both the interpretation and intention of the law were ambiguous in their application to bicycles. Since Carr, Louisiana lawmakers have not amended the statute to include bicycles.
