He doesn't have hospital bills he's going to owe? In 2010, I was in the hospital for a couple of months, and had 11 different surgical procedures. Had really good insurance, but still owed about $8000.00 when I got out. I was getting bills from doctors offices the insurance didn't pay for another couple of months.

It is 2017 (almost 2018), so follow these steps:

1) Open a GoFundMe account for your Uncle.

2) Take his next Wal Mart paycheck to a Public Relations agency and get them to pitch his sob story to the media.

3) Your Uncle can retire from the windfall.

Under the new laws I think you have to do a Chapter 13 where you set up a payment plan to pay monthly until all debts are paid off.

The legal fees are rolled into the payments.

Sorry to hear about your relative. You can thank useless people like my ex wife for making the process so difficult. Perfectly capable of working but wants to live free and be a full time drug addict.

You need to start applying for disability immediately. You will probably be turned down. You will need a doctor to declare you unfit to work. Once you have that you will have to hire a lawyer to get you disability. Once you are approved they will back pay you from the date you first applied for it.

I’ve known several people who got quite large checks from this. It can take quite a long time for this process to play out. Good luck

This seems like a good thread to remind people of the benefits of long term disability. If you don't have it, consider it.

90% are rejected for their initial SSDI disability claim. Depending on your location, at the appeals level, almost half win their case. Some judges are very, very difficult. And in my experience it's a total crapshoot. I did appeals for about a year, only took what I thought were absolutely slam-dunk cases with great medical records. I lost an appeal for a guy with full-blown AIDS (and was missing a thumb) because AIDS only meets a disability listing if it includes chronic diarrhea or other complications. The judge asked all sorts of irrelevant questions about his lifestyle & arrest record. That one is being appealed to the Appeals Council. I lost all faith in the system after about 6 loses.

It really depends on what ALJ you get in front of. I’ve had some mystifying experiences too.

Incorrect. He needs to take a means test to figure out if he qualifies for a Chapter 7 ($335)or 13 ($310). But get a lawyer.

FYI: Cheap(unethical) lawyers will push you into a Chapter 13 when you actually qualify for a Chapter 7. Chapter 7's cost more than Chapter 13 (where the lawyer can collect fees from your monthly repayments). They'll advertise $899 Chapter 7's which are never this cheap.

Once he gets disability income, do not co-mingle the money. This income cannot be garnished by bill collectors.

Completely false. I've had clients get new mortgages/car loans/credit cards within a year of discharge. Some exit with 700 credit score.
