Why would you put a password on a work phone.
In order to receive work email on my phone, it must have a password. My work email will not work on my phone if my phone doesn't have a password.

Yes you will, and if they want to, they'll file an anti-trust case against you, and then hit you with RICO

In this scenario he doesn't have the phone anymore, so how is there use of the phone?

Sure there is. Dont give up the password to your company phone.
OP, don't answer any of their calls. Only reply to certified mail.

Was Fired
Why were you "fired"?
Are you eligible for any type of severance package? If so, what are the terms and conditions?
quote:This may not be the case. Information related to your work is more than likely property of the company.
He says that any information on the phone is the property of the company
Personal information stored in the device may not their property, but they may have a right to review it.
You should have an attorney scrutinize your contract with the employer and any additional agreement(s) you may have entered when you began using that device.
quote:
He told me that if I don't, he'll get a court order to make me give the password up.
Once again, this is largely dependent on the jurisdiction and any documented agreement(s) between you and the employer.
Just ask yourself one question, do you have more to gain or to lose from willfully complying with your former employer's request.
TL;DR - Find out what your legitimate rights are, then act accordingly.
Or don't,
either way,
I don't give a damn what you think you are entitled too!

Yes he is. I just like playing devil's advocate.
Go get a po box, send a certified letter to your ex-employer notifying them of your address change and never check the po box.
