That's certainly one way, but if he could manage 20 on a manslaughter, he's out in 15. Certainly not easy, but also not life ending.
I do think 25-30 is the lowest you'd manage here, and it would have to be on the front end.

Something like this and a kid who looks like that, likely Frank Desalvo, Billy Gibbens, Ralph Whalen, maybe Kevin Boshea or Magner to help get it ready for appeal if it's gonna be tried.

Unless they have a reason to plea it to probation, as in there's some issue with the case, he isn't getting probation. I don't even see a scenario where it would happen, they'd rather gamble trying to do the right thing than put someone on probation for intentionally taking a life. Unlike many cases in Orleans, you're simply (likely) risking the punishment, not more loss of life if the defendant gets out and goes right back to drug rips. Probation isn't punishment at all, so might as well put it in the hands of the jury and go for life if he doesn't take 25. I know I would.
And giving a white guy probation on a murder of a black guy in Orleans? Political suicide. Dog shite murders get 15 year manslaughter pleas, and that's pretty much once they've killed off all the witnesses and you have nothing left.

Why is it always about money? Some of y'all watch way too much Law and Order or bad cop shows. It's about facts and the circumstances as to why this happened and how we got here. He kicked a guy during fight and that's pretty much as far as we got. This guy wasn't out auditioning for the newest season of Bum Fights so something happend to cause this. We will find out in time.

The worst part is going to be waiting for the trial if he has to sit in OPP. I figure his family will figure out some way to bond him out though.
That kid that ran over all those people at Mardi Gras has managed to stay alive in there all this time. Of course, he didn’t beat to death a defenseless black man either. I say defenseless, because those gorillas in OPP are gonna see it that way regardless of what the facts may be.

Because money plays a huge factor in the prosecution of these cases. It’s sad, but representation is almost everything in a state or city court. Trust me, I have been through this process more than the vast majority on this board (of course, minus the attorneys) and I’ve seen it first hand in my cases along with the 100 other cases I have close knowledge of in the state of Louisiana.

Exactly. He intentionally kicked a guy in the head during a fight, and the guy died. Unless the 60 year old victim was robbing or raping him, that's called murder.
Oh, and as far as watching Law and Order, I've probably prosecuted as many cases in that building as you have seen Law and Order episodes.

Yea this is definitely a clear self defense case. He just couldn't manage a finding of no PC at his first appearance. Probably was just excited to pay his first bail bond.
And in all seriousness, there is very little you can stomp a 60 year old man in the head to death for in self defense. Not even a fist fight gone south. Pretty much what I listed is all you'd be able to sell to a jury.

The judge bases that almost entirely off of the arresting officer's statement at that point. Since you are a seasoned prosecutor can you give me some rough estimate of how many people end up convicted of the crimes brought against them at their arraignment?

the only way this dude avoids prison is to be acquitted . Probation wouldnt be on the table for a case like this, its kinda straight forward..just my personal opinion
