That's still second degree murder, and it's the version I'm most inclined to believe at this point.
To me, that's Ward's best case scenario.
The only way I'm going to believe there was a mugging attempt is if the old man had a weapon.

That’s fine as well. My theory rests on the fact that ward didn’t just decide to beat random guy on the street for nothing. Whether correct or incorrect assumptions were made on the situation.

I don't think anyone believes Ward picked out Red and just beat the frick out of him.
Do you know or have you heard if anyone was there besides Ward? Any friends, or was he alone?

The guy was blackout drunk. How do you know for "fact" what HE decided? He doesn't know for sure, does he?

Don't think he's applying the idea correctly. The mugging is the ad hoc part of this and the deflection. If it really happened, then there will be evidence brought up. We don't know. If it was a random beating for no reason and a life was lost, it will be brought up too. Sadly, two families lives have changed.
