As a matter of fact, it is. He's not making specific threats to a specific person. You can say "we need to kill cops" and you're protected. But if you point to a specific cop and say "we need to kill that cop", then you're gonna be in trouble

Specificity has nothing to do with it. If you start yelling “we need to kill these cops,” you best pray no one acts. If they do, you’re fricked. The only ground you have in this case is that nothing happened. You can’t guarantee that will be the case every time he makes such a statement, particularly as the audience changes.

Specifically naming an individual as the target of encouraged violenece is not a requirement. The only thing saving this guy is that what he says can certainly be argued as not encouraging “imminent and likely” action. Problem with this is you can make that argument in most cases, but the second someone takes that person up on what they say, you just passed the “imminent” test.

Ditto. And if a kid stood up in class and shot a white student (we have campus carry in GA and faculty are keenly aware that any student in any class may be carrying), he’s in trouble.

Disagree. The guy just said "white people may have to die". That's way too broad to be deemed imminent and/or likely"
