According to United Airlines’ contract of carriage, “(An) Oversold Flight means a flight where there are more Passengers holding valid confirmed Tickets that check-in for the flight within the prescribed check-in time than there are available seats.”

Brodkowitz said if the airline was removing people in order to make room for crew members, one could argue this was not an “oversold” situation.
Nah, that 1 poster that 1 time said so... Just cause.

We obviously disagree on that. So why do you always circle back

So that's the sticking point. It's fair to agree to disagree here. Would a judge/jury rule that this flight was oversold?

I think we'd both agree the case pivots on that.

y'all do realize that for every lawyer that argues one way that there is one on the other side

And the verbiage "one could argue". Isn't quite as strong as you make it out to be

Oh, and dick. I was being self deprecating about the whole pass thing. Be a fricktard about it if you must. But your complete ignorance of anything mentioned is inexcusable.

Stopped reading.
My apologies for an erred statement. The letter was to the Chicago Dept. of Aviation about their officer's actions.

The Senate subcommittee is also asking for answers from Oscar Munoz, CEO of UAL.

It will be interesting to see what happens, if anyone is paying attention in a day or two

Honestly I don't think it really matters. The fact that this guy even remotely has a case will mean this will never sniff a courtroom. UAL will bury this as quickly as possible so everyone forgets about it.

The last thing they need is for this to go in front of jury and have even have the smallest possibility of winning in court, much less be kept alive in the public eye.

There's nothing good that can happen by fighting this in court.

No way it could go that way. We have two links that show the experts saying otherwise...

Junky: United could have deemed the flight overbooked
DisplacedBuckeye: 100% correct
tigerfoot: It clearly reads you can be removed in an overbooked situation.
Me: wasn't overbooked, they did not sell more tickets than they had
tigerfoot: yes they did
United: Flight was not overbooked

United spokesman Jonathan Guerin said Tuesday that all 70 seats on United Express Flight 3411 were filled, but the plane was not overbooked

Still 100% correct. Your link doesn't change that. Still winning.

I was 3' from him about 10 years ago and his face is stretched so tight that I don't believe he can blink.

It is about 60% better on TV though. I wonder how a U.S. Senator can get such botched surgery? Wouldn't they have the best surgeons available?

His eyes are also kind of dead and he seems to run on autopilot.
