According to United Airlines’ contract of carriage, “(An) Oversold Flight means a flight where there are more Passengers holding valid confirmed Tickets that check-in for the flight within the prescribed check-in time than there are available seats.”
Brodkowitz said if the airline was removing people in order to make room for crew members, one could argue this was not an “oversold” situation.

So that's the sticking point. It's fair to agree to disagree here. Would a judge/jury rule that this flight was oversold?
I think we'd both agree the case pivots on that.

Honestly I don't think it really matters. The fact that this guy even remotely has a case will mean this will never sniff a courtroom. UAL will bury this as quickly as possible so everyone forgets about it.
The last thing they need is for this to go in front of jury and have even have the smallest possibility of winning in court, much less be kept alive in the public eye.
There's nothing good that can happen by fighting this in court.

I was 3' from him about 10 years ago and his face is stretched so tight that I don't believe he can blink.
It is about 60% better on TV though. I wonder how a U.S. Senator can get such botched surgery? Wouldn't they have the best surgeons available?
His eyes are also kind of dead and he seems to run on autopilot.
