You should leave this out. Whether he had a gun or not shouldn't even matter. How is she supposed to know he doesn't. Dude was off his rocker and acting crazy

Yep. Weren't they also called because he was claiming the car was going to explode? So, at that point, him doing anything near the car would be highly suspect. Doesn't justify anything, but let's stop this he was killed simply for not following commands.

I believe the inital call came out that he was running from his vehicle yelling that it was about to explode. So, also keep in mind that when he returns to the vehicle, the officers don't know whether he has some intention of blowing up the car. It just isn't clear how much communication they had with him before

Yep that and the pictures of him with his hands down and reaching into the vehicle is enough doubt for a jury to let her walk

Most likely it will go to a grand jury.

Bad news for her that they chose manslaughter and not murder.

While this should be true, she has already given statements through her attorney about what she thought was going on. She made no reference to a belief that she thought he even remotely could blow up the car. No pun intended.

Actually I think its fricked up this women is being charged with manslaughter. What else was she suppose to do?

Thousands of cops interact with tens of thousands of people every year, some of whom are seriously fricked up in some way and genuinely belligerent, without shooting them. Maybe she should do what they do.

You're conveniently leaving out key points pertaining to these shootings.

I don't necessarily think she shouldn't to be honest. The facts still aren't out and based on that video alone, he was clearly ignoring lawful orders while reaching inside of his vehicle. Should cops just wait until they're shot before taking action to defend themselves? Handcuffing the police is a bad policy. It's one of the reasons I left the military.

car about to explode

Have read officer Shelby's account, which she described through her attorney, and nothing was mentioned about Crutcher claiming his car was about to explode.

LINK

Do you have a link to that aspect of the description of the events leading up to Shelby shooting Crutcher?

Four elements

Ability, opportunity, imminent jeopardy, and Perclusion.

Ability: does he possess the means to commit deadly force

Opportunity: is he within range to use a weapon

Imminent jeopardy: are you in fear for yourself or others lives

Perclusion: have you done everything in your power to avoid using deadly force unless it's absolutely warranted

She had basically one out of the four elements since it seems she was in fear of her life.

It's not a perfect system, it's reactionary, and has the officer at a disadvantage. But, it's the rules she has to follow and since she didn't, she isn't legally right.

This was from one of the 911 calls regarding his vehicle in the middle of the road. He ran past the person who called 911 screaming his car was about to explode.

But what if you dont know someone has a weapon or has something that appears as a weapon but isnt?
