I couldn't know less about Canadian constitutional law if I had actively tried but in the lens of American jurisprudence, it doesn't fit this situation as I understand it.

You can not exercise a right if that exercise infringes on the rights of others. Purposely blocking commerce is not a right covered under our 1A and breaches the "peaceably" verbiage. It is often tolerated for short periods as a matter of equity. Peaceably and peaceful in con law are not just a synonym for non-violent.

This has nothing to do with the validity of their protests nor the proper actions of the Canadian government and one could make the argument these factors should allow for non-peaceful protests but the right to peaceful assembly is not the correct constitutional shield for those that are actively and consistently blocking commerce. There are however likely many of the protesters that fully meet the concept of peaceful assembly and their treatment is "required" to be different than those that are not.
