I have no idea, but I'm pretty sure it's easier to sneak contraband into a penitentiary than it is to bring cupcakes for a class of ten 3 year olds. US customs does conduct as extensive a search as the daycare staff does with cookies. Any hint that the cookies may have been produced in a factory that also handles peanuts and you may as well just bring the hazmat team in.
When I was a kid we had 75 people in my class and everyone's mom brought snacks for the class on their child's birthday. I'm sure some, if not all, were produced in factory that handled nuts. Hell, many of the snacks actually had nuts in them (as well as gluten, real sugar, and other "poisons"). Looking back, I guess it's a minor miracle none of us died. The worst thing you had to deal with was the fat kid eating too much and blowing chunks at his desk.
