The new “ban the box” movement that will soon come because of diploma privilege

First it was banning employers from asking criminal history.
Now they will demand that firms be prohibited from asking applicants if they’ve taken the bar exam because of bar discrimination preferring people who have actually undergone the rite of passage.
This will be coming soon in every state that is doing this.

Corrected to “ban the box.”
quote:
Ban the Box is the name of an American campaign by advocates for ex-offenders, aimed at removing the check box that asks if applicants have a criminal record from hiring applications. Its purpose is to enable ex-offenders to display their qualifications in the hiring process before being asked about their criminal records.

We don’t need to ask. The Bar roster has date of admittance next to your name, forever.

I'm sure ban the box will be expanded
But I don't think bar passage is some "next big step" in that, and is more a niche issue which will follow, if at all, several other slippery slope items stemming from banning the box.

So employers can still ask, they just have to consider the person’s qualifications first?

Didn’t even think about this. Privileged list they’ll say.

Do they not realize it’s going to show up on a background check?

I mean, it's currently available to the public, so wiping it so much that even attorneys can't see it is quite a stretch
