From my understanding, the state has possession of the video from the Tesla for a very long time before trial. The judge never saw it because that's not how the rules of evidence work if it's not subject to a pretrial motion. They went all the way through the jury trial, both sides had rested, and the defense asked for a directed verdict. This is a common request in a criminal trial, and rarely granted. A directed verdict is a ruling by a trial judge that takes the final decision away from the jury and orders a specific verdict because one party has not provided enough legally sufficient evidence to support its case. The most high profile directed verdict recently that I recall was in the Kyle Rittenhouse trial when they said he was unlawfully in possion of a firearm because it was a short barrel rifle. No evidence was ever presented at trial that the rifle wasn't a legal length so the directed verdict was granted on that count.

I’m assuming this is AI.

Everything else about the stop and arrest was ridiculous but I don't have any issues with the gun being drawn initially. Finley was coming from a closed garage so who knows what he had in his hand so that was justified.

Who knows what's in the hands of every person stopped for every traffic violation. Should we train our officers to approach every vehicle with their pistol drawn and trained at the vehicle occupants?

Walking up on a vehicle, full of windows, is a bit different, than someone coming from inside of a closed garage. Especially if you think the person was fleeing - which I'm pretty sure cops approach fleeing vehicles with their guns drawn as well. Again, he wasn't fleeing and the felony is completely ridiculous and unjustified but I don't have an issue with the gun being drawn here.

The Cop is a P.O.S., but why did he close the garage door, then open it again?

I copied the definition of directed verdict, other than that, no?

Cop was definitely lying, or at least embellishing, but I think the driver had a feeling that cop was turning around for him and was trying to get in his garage as fast as he could.

The irony is that the tesla camera supported the driving pattern claimed by the defendant.

The police camera showed the law enforcement officer doing all of the things that he claimed the Tesla driver was guilty of.

Only one of the two drivers was reckless. And it wasn't the tesla.

My understanding is he may have ended up getting hired on with another municipality.
This event was 2 years ago so he had plenty of time to move agencies.

The other troubling issue is why did the prosecutor not turn down this case in the first place after reviewing the evidence?

There was only a 2 second span when it was possible for the tesla to have even seen the cop.

The Tesla accelerated hard on the left turn. It is more than likely that the focus was going forward than behind.

And at that point, the cop car wasn't in the camera view again.

The tesla driver didn't see the cop car until after the door was in operation down. Which is why he raised the door.

That is the proper question.

The LEO was still on the force at the time of the trial this year.
But as was said earlier, it is fairly easy to move from one municipality to another.

I think there’s a chance he saw the cop as he passed and realized he may be in trouble. I’ve passed cops before going too fast and checked my rear view mirror right away. I’ve taken an earlier turn too just in case they were turning around for me.

Cop car was unmarked.
Virtually impossible to see as you pass unless the lights are already on.

I think they show the car in the video.

He closed it because he thought nothing was wrong.

He opened it again because he though something was happening to a neighbor. In otherwords he was being nosey

Cop car was lightly marked but non unmarked. I’m not sure why, but in most of the videos the marking is blurred out. There are some shots where you can clearly see it has Police in large letters across the side. Maybe he didn’t see them, I just think there’s a chance he did. Cop still overreacted either way.

In my head, an unmarked car still has markings. They are intentionally camouflaged so that you do not see them.

Maybe there is a different word for that type of cruiser.
