This artist is pretty clearly just exploiting this whole situation for more publicity.

If this woman is so mind blowingly rich, WTF do they care about this for? She was offered between 1-10K, which is obviously not a ton, but who cares? That's like a fraction of a penny to regular people.

I like Taylor but it's nice to see her at least take some kind of publicity hit. She was on the fast track to sainthood the way things were headed. Does it make me a miserable human being for wanting her to get knocked off her high horse purely out of jealousy? No, and frick you for thinking that

Right, except that plaintiff's attys work for contingency fees. Defendants don't. It's typically way more expensive to defend yourself in civil court.

I appreciate that TS likely didn't have any idea the art was copied. I also appreciate that, unlike plagiarism, there isn't a real good way to verify a work's originality. The solution to all of that is, of course, to HIRE YOUR OWN ARTIST AND GET THEM TO DESIGN YOUR ALBUM COVER.

So they should just let TS do whatever she wants with the art? No. And I'm sure she was sick of hearing "hey, it's the Taylor Swift fox."

no, of course not. If what we're reading is true, TS didn't do it intentionally and thought she was using fan art. Which would have been perfectly fine. She also took it down off social media when this started.

My question is...why is ally's side leeching onto this grabbing for more money? When ghetto queens get into a fender bender and pretend their spinal cord just snapped, I get they're just trying to scam the system so they don't have to work and can have free money. But you're saying that this family is century-old money and can buy the moon, so why should they try to ask for more than was offered? Take what was offered, soak in the free publicity that she'll now get worldwide, and move on.

Oh, I'm sure she can afford it, but she'll end up spending a lot more than they wanted just to get through this suit.

Also, I'd bet the publicity is welcome. That's another angle to consider. If it becomes widespread knowledge that TS likes her art enough to associate it with her music, it could lead to a lot of success, if only temporary.

Like I said, I don't think TS is personally at fault, and I think she was just trying to be a person who connects with her fans, so much that she posted this picture.

However, she (or her people, or whomever represents her in this) is at fault. I don't think they had any ill intent, but they did, in fact, use art without permission. It's actionable, and I personally wouldn't let someone get away with it no matter who I was or how much money I had.

And again, the publicity could be the whole point. Who knows?

I don't blame her for getting the publicity.
Also don't blame her for wanting to get some compensation, especially if the fox is a staple of her brand. If an image I created was identifiable with my brand and used for promotional purposes of a $100,000,000 business venture, I'd want my cut too.

Eta: if Swift reps are in CA, I'd also file in California courts, then proceed to laugh straight to the bank.

A fan has stated that she created the watercolor drawing of a fox, added some of Taylor's lyrics and signed the artwork as her own, posting it. Ms. Swift, believing it to be the fan's original work, reposted the fan's art, with her own comment, continuing the social media conversation. Ms. Burguieres did not contact Taylor's office, but she posted on social media her claim that the fan had used her drawing. We found that posting, accepted it at face value and immediately took down Taylor's posting of the fan art. At no time during these postings did Ms. Burguieres contact our office directly. Notwithstanding the huge publicity this has generated for Ms. Burguieres and her store, in early November Ms. Swift's office made a fair offer of payment well above a reasonable licensing fee for the short time that the fan art was posted online. The offer was for a payment to Ms Burguieres—there was no requirement of a contribution to any charity. Her lawyer further advised us that Ms. Burguieres chose to go after Taylor only and not against the woman who has admitted she used Ms. Burguieres' work as inspiration. Ms. Burguieres' lawyer acknowledged Ms. Swift's action was unintentional, but rejected the offer. She promised to get back to us with an explanation of why she felt Ms. Burguieres was entitled to more money, but she never did that and the next we heard was Ms Burguieres' new posting. We have tried on multiple occasions to address Ms. Burguieres' concerns, but these actions make it clear to us that this is just an unfortunate effort to extract more money and more publicity.

I don't have an exact number but low 5 figure sounds fair with a statement that whether or not Taylor knew about who painted that picture but to announce and give credit to the artist.

Whether you like her or not, that's her property. What if someone liked that picture and wanted to buy it for something but the other artist got it because Taylor endorsed it (intentionally or not). I would even be okay if Taylor just announced who the actual artist is. The right recognition would be worth way more than even 10k.

Hell, a little 10k on Taylor's side would probably shut that woman up and give Taylor a +1 on likeability for supporting local without actually giving a shite what the woman does with it.

T Swizzle can use my artwork anytime she pleases, I'll make a deposit in her "account*" for her using it.

Bad joo joo. Swift would probably be pretty pissed if someone used some of her material, even unknowingly. Probably wouldn't cave in for a 4-figure sum to her favorite charity, either.

Well, I guess you're saying I should have jumped on that money train before it left the station. Damn.
