I would think this more accurately describes "premeditation" as he planned what to do and how to not get caught presumably from the entire time he left the restaurant property. There has to be more time to carry out a plan when the word premeditated is used.

Smith's murder was a "crime of passion" so to speak. It was the heat of the moment, not well thought out or planned

Fast food restaurant on Burbank near LSU.

A thug.

This guy harassed me for 15+ minutes while I was trying to read the menu and place the order. He called me not so very nice names: skanky ho, whore, bitch, etc. Initial contact was unprovoked. Thug attempted to talk to me when I was reading the menu board, and I'm like "Dude, please don't talk to me, I can't concentrate on reading this. Also, I was here last night. I know how to order, this isn't my first rodeo. Please don't talk to me."

Restaurant manager wouldn't call cops and I had forgotten my cell phone (all of which The Thug knew because 1. no cops came and 2. No purse, just gate clicker and debit card.)

After all the abuse, I could not bite my tongue and called Thug a not so nice word in return for all of his abuse. At that point, he then said "I should hit you for saying that." I then replied that it was assault and battery.

Anyhow, he "left" and I eventually ordered and received my food. As he was punching me in the face, he asked me if my mother would be proud of me for calling him what I did. Funny thing is, he never mentioned how his mother would feel about him beating up a woman.

After the attack, I went back to Sonic wearing my shake and then BRPD were called to the scene.

Moral of the story: Bite your tongue off before making any retaliatory comments to anyone. It could save your life.

When I patron restaurants near my condo, the only people that I talk to are the employees, particularly if I am alone. I don't engage anyone and this was true before the attack.
