I think the DA ought to go for murder one. It's premeditated as hell.

He rams Smith's car

gets out with a gun,

and proceeds to light Smith up.

That's 1st degree murder right there

I'm more of a facts guy right now in this case, but one thing is clear... hayes was ready to tango and its made abundantly clear when he rams Will's car from behind.

Drew Brees is not a witness, nor was he there. You were quoting Drew's word like it was gospel just because he said it. Everything he said is here-say. It seems you were basing most of your conclusions based on his interview.
what exact conclusions have I based off of drew's interview. That interview was late last night before i heard it and had been arguing all fricking day.

Or is it there-say?
FYI, the word is hearsay.

If someone is threatening me, and I announce that I have a gun, have I committed a crime?
Do I deserve to be shot in the back multiple times until I'm dead?
Do I deserve to be shot in the back multiple times until I'm dead?

Smith's murder was a "crime of passion" so to speak. It was the heat of the moment, not well thought out or planned.
This... That's why it's 2nd degree.... and his lawyer is pushing it further going for the manslaughter charge...

'm just saying its not a fact as you keep presenting. The guy you keep saying was an "eye witness", appears to me to not be an eye witness to the shooting. Rather a guy who overheard someone else.
guess it all depends on what you want to hear. It's plausible that it is second hand, but you're talking about a rather large detail of both guys having weapons.
Cops arrived on the scene within 4 minutes. This video is taken shortly thereafter. Even if 2nd hand, it's not like there was a lot of time to criss cross stories.

No you haven't, but it's not the smartest thing to do....
No... That's why he's being held on 2nd degree murder charges with a million dollar bond set..

its been said 100 times in this thread that if since will said he has a gun first then that means obviously hayes felt is life was in imminent danger and was justified in shooting smith in the back. in order words (frick ya'll i got one too....)

Get's it.
2nd degree murder is the correct charge unless it's proven he planned this.

Shouldn't have a problem linking it then.
All I've seen is people saying it justifies the charge of 2nd degree murder or manslaughter.

no i had just been hit in the rear end by some a-hole who tried to hit and run and now he is threatning me with a gun....

It's an honest question.
I don't feel like he deserved to be shot for saying that.
Hayes should have sat down in his vehicle at that point. Cops were on the way.

Im an ahole for listing facts? Im sorry Smith wasnt some innocent bystandard here. Im sorry your saints hero was responsible for a hit and run. Im sorry he got out and threatnend someone with a gun. Im sorry his actions caused him to be shot.
but dont let the facts get in the way here.
