its a raw video directly after the shooting took place. A guy describing it to his friends. I dont know who he is, looks like a guy that lives or was at a bar in the area.

I have a feeling he'll go down for it too. Should be an easy case for the prosecution.


Lots of evidence already to suggest Hayes is guilty.

You're right. He planned all of this beforehand. All the way up to the killing. Post shooting rampage, he began to wing it. The result: Calling 911 and waiting for the cops.

This guys doesn't wing it very well at all.

I've seen that video, and can't understand it all. I know the article says the guy was a "witness", but you certainly can't tell that from the video.

I jus think about how many times I've walked up on the aftermath of something, been told what happened, then repeated what I was told to the next people that walked up and asked what happened.

The fact he said "I guess" really makes me wonder if he actually saw it. At the point of the video, Hayes is in cuffs. I imagine he was trying to tell the cops Smith was going for his. Maybe this guy overheard that.

"I guess this guy was like, 'Get out of here or I have a gun,'" the witness says to the camera. "And he goes, 'F--- y'all, I've got one too.' And he grabs the gun and then he shoots him the back – dead."

I agree. Hayes saw them all out partying with his father's killer, plus Smith was everything he wasn't and it set him off. It triggered long suppressed feelings of anger and resentment which set in motion his insidious plan

i think he was just trying to process his thoughts. Anyway, I think the biggest detail in his account is that both guys claimed to have had weapons

I think "premeditated" covers more than 5 or 10 minutes which is probably the time frame from the first hit and run by Will Smith to the shooting.

I was beat up by a guy 11 months ago. He was harassing me at a BR fast food restaurant. He made the appearance of leaving the location. I remained where I was for at least another half hour, maybe longer.

As I was walking home, he came out of nowhere and attacked me as I crossed a side street halfway between the restaurant and my residence.

After he beat me up, he sped off in a car with his license plate obscured.

I would think this more accurately describes "premeditation" as he planned what to do and how to not get caught presumably from the entire time he left the restaurant property. There has to be more time to carry out a plan when the word premeditated is used.

Smith's murder was a "crime of passion" so to speak. It was the heat of the moment, not well thought out or planned.

Drew Brees is not a witness, nor was he there. You were quoting Drew's word like it was gospel just because he said it. Everything he said is here-say. It seems you were basing most of your conclusions based on his interview.

I'm not trying to say Smith didn't have a gun, or didn't reach for a gun. I'm just saying its not a fact as you keep presenting. The guy you keep saying was an "eye witness", appears to me to not be an eye witness to the shooting. Rather a guy who overheard someone else.

Until we know who he heard that from, its invalid. Its a drunken game of telephone that was possibly started by the shooter talking to police.
