I think it will be second degree since he had a few minutes to think about it, left, came back and argued again. He needs to go away for at least 20-25 years. under no circumstances should this ever happen.

He already has the "he threw an unknown object at me" defense....may get charged with 2nd degree but manslaughter will most likely be part of the plea deal.

People celebrating a guy getting shot over texting are the people who want others to live in the same amount of fear that they live in.

This defense will be thrown out because as a retired officer, he SHOULD have known better. Thrown popcorn does not equal a handgun in the scheme of elevation

i've got a feeling that the old man didnt come back in the theater and go quietly to his seat. maybe im wrong and the dead guy is just a huge prick and threw his popcorn at the guy unprovoked, but since he is a middle aged guy and he was with his wife in the middle of the afternoon, i dont think so. Maybe if he was a younger guy and it was late and he was with his buddies trying to be "cool" then i would tend to believe he threw the popcorn unprovoked.

yeah, especially because he's a retired police captain so he's got some authoritative complex. he had already started arguing with the victim before he went to go talk to management, so he was clearly looking for a confrontation. if he had wanted to, he could have just went and talked to theater management without saying anything to the victim. that's what i would do if i had a real problem with someone in a theater.

If all the dude did was throw popcorn then the old man should go down.

Now that I've said that, why can't people understand that it's little things that lead to bigger things? Young dude should have quit texting or go out of the theatre to text equal no shooting. Old man tell someone working there about problem and wait on them to act equal no shooting. Either one of these things had taken place problem solved. Either one of those things happens, little kid doesn't have to grow up without a dad. But frick that lets act like children and throw popcorn or pull out a weapon for stupid shite, either way neither of them acted like an adult.
