The left judges voted against the administration.
Which means they were arguing against the death penalty and not ruling on the letter of the law and whether the sentence should have been upheld because of the trial judges actions.

This pisses me off more than anything about SCOTUS, on BOTH sides. They rule on feelings and partisan instead of legality. frick all 9 of those turds

Doubt it. This was an appeal on actions by the judge concerning evidence he didn’t allow and the questions he posed to potential jurors about media exposure. I’m sure they will appeal the conviction now too, instead of just the sentencing….but I’m not sure how that works honestly

Also, probably didn’t help his case considering he and his brother were Chechen/Russian born. Bad timing for him on this one

But I think this begs the question. There are multiple theories of legal interpretation. I happen to be an Originalist, but I have no objective claim to that being correct over any other school of interpretation. So while I agree that a justice’s political ideology is obviously going to influence their ultimate decision, I consider that more of a tautology than a true accusation.

I haven’t finished reading the opinion yet, but halfway through the dissent, I think anyone arguing that it isn’t based on law is being disingenuous. And I say that as someone who doesn’t necessarily agree with the dissent in this case.
