We 100% agree about the Ronaldo case. I thought we moved past that.
then what are you arguing? i'm not sure how you could understand that case, and still be confused on what is rape....
stuff you are talking about "is this rape?" would be considered sexual battery, which is NOT rape, but still a crime, nonetheless....

You are making consent way more difficult than it really is...its not that confusing. If it is...I would advise not continuing sexual activity.
I’m not. You just said this...

As far as having sex with someone who had a few drinks. I would never take that chance
Why would you say that if it’s cut and dry?
Sounds like you are saying there is a level of intoxication where consent is ok and then it gets to a point where consent isn’t ok.
How do you define that point?

Ronaldo raped her. I’m always skeptical of stories like this because of where the whole “rape culture” is going.
Now I am discussing with Jody Plauche how rape isn’t as clear cut as he likes to think simply because we can’t even define what consent is. He posted a long definition that he thinks works but he can’t tell me anything specifically, like when exactly someone is too drunk to consent.

This is how I would judge it.
You can have a few drinks and NOT be intoxicated.
If a person is intoxicated to the point you would not let them drive...don't touch them.
If they have had a few drinks and don't seem impaired...get their consent and have a good time.

Question 1
Can she coherently make full sentences and communicate?
No - rape
Yes - question two
Question 2
Does she regret having sex when sober after saying yes when drunk?
No- not rape
Yes- rape

HAHAHAH
HAHAHHAAHA
you are a nationally known “rape expert”?
That’s just pathetic. That is the most vague advice I’ve ever heard. You are willing to ruin college kids lives based on that definition of intoxicated consent?
Posted on 12/1/18 at 1:30 pm to JodyPlauche
Look I understand and respect your desire to never let anyone go through what you did.
But there comes a point where too much effort leads to more harm done. There is a point of diminishing returns. How many innocent college kids lives do you want to ruin to catch one rapist? Is there a number?
I hope you think long and hard about that

definition of intoxicated consent?
According to the law, a person intoxicated is incapable of giving consent. Just like a child, mentally disabled, or unconscious.
If you are will to risk a rape accusation from having sex with a drunk person. Good luck. You will get no sympathy from me.

Again...not the best question. Obviously NONE.
But I'm willing to get people to speak up and hold those who do commit rape and sexual to be held accountable and punished for their criminal behavior.

So one drink? One sip? What defines intoxication? What if they drank the night before and still have detectable alcohol in their blood the next morning?
What if you don’t even know someone had a drink before you started talking to them?
You can’t answer any of these questions but you are ready and willing to ruin college kids lives without sympathy. That’s sad, pathetic, and dangerous. In my mind, your type is just as dangerous as these “college rapists”

If a girl and I were both equally drunk and consented to sex, then she claimed rape the next day, I think I'd just counter by also claiming rape and pressing charges.

Which one of you do you think will go to pound me in the arse prison though?

By making the definition of consent mean zero intoxication, which has to be any detectable blood level otherwise it’s not definable, even if you don’t know if they are intoxicated... you will ruin countless young lives.
How many will you save?
If you don’t know that answer, maybe you should be a little bit more cautious. Throughout history, plenty of people have done more harm than good in the name of righteousness.

Probably me, but I would definitely make up a bunch of shite about her being the aggressor and me possibly being drugged.
I would turn that shite on their head.
Obviously the defense of "It wasn't rape, it was consensual" doesn't work, even if both parties are equally drunk. So I'd just claim the woman raped me
True story:
A girl that was trying to hook up with me in college, who was average looking but not bad enough to be ashamed of hooking up with, put my dong in her mouth while I was passed out on my bed. It was her attempt to wake me up to hook up at a late night at my house. And I must say, it worked quite well

I guess that's something you and potentially a jury has to decide.

Jody, sometimes I buy a bottle of my wife's favorite wine because I know she'll drink a few glasses and that wine drunk makes her horny.

Jury is given applicable law definition
What do you think the legal definition should be
