I guess that's something you and potentially a jury has to decide.
Exactly. You don’t know. No one knows unless it’s zero or you have a minute by minute blood alcohol level.
Even if it’s zero you have the problem of them drinking without your knowledge.
Again, how do you know you aren’t doing more harm than good?

From the stuff in the OP, Ronaldo raped that woman, and there is no getting around that.

That's all good.
The law is there to protect the person so drunk they are passed out.
I see people leave the bar legally intoxicated and make it home safe.
If they are visibly intoxicated I would get them an Uber.
There is a fine line when it comes to intoxication. I just tell guys it's better to not put yourself in that situation.
And real quick, this is intended for Wawa, let me address the myth of regretted sex leads to false rape claims. It rarely happens. So that too is a b.s. argument.

Wrong. Kids have been accused when no one is passed out.

What do you think the legal definition should be
I have no problem with the law
quote:
The statute for third degree rape can be located La. R.S. 14:42. This crime is committed when the anal, oral or vaginal sexual intercourse is deemed to be without the lawful consent of a victim because it is committed under any one or more of the following circumstances:
The victim is incapable of resisting or of understanding the nature of the act by reason of intoxication and the offender knew or should have known of the victim’s incapacity.
The victim, through unsoundness of mind, is incapable of understanding the nature of the act and the offender knew or should have known of the victim’s incapacity.
The female victim submits under the belief the person committing the act is her husband. This belief is induced by an act of artifice or pretense by the offender.

Ok. I prefer PubMed/scientific papers....

False rape allegations. Kanin EJ. Arch Sex Behav. 1994. Show full citation Abstract
With the cooperation of the police agency of a small metropolitan community, 45 consecutive, disposed, false rape allegations covering a 9 year period were studied. These false rape allegations constitute 41% the total forcible rape cases (n = 109) reported during this period. These false allegations appear to serve three major functions for the complainants: providing an alibi, seeking revenge, and obtaining sympathy and attention. False rape allegations are not the consequence of a gender-linked aberration, as frequently claimed, but reflect impulsive and desperate efforts to cope with personal and social stress situations. But I never even argued this point. I think it’s irrelevant because we disagree on the definition of rape/consent. So the fact that it’s labelled false doesn’t matter to me.

But you are right... if you google it you get a bunch of CNN articles about Kavanaugh and statements that false allegations don’t exist
