ETA: was knife ever shown or threatened or he just happened to have a pocket knife unknown to shooter?
The knife and the fact that the Shooter can say that he saw the knife and he saw the Attacker reaching for the knife makes this a lot more easy.
The more interesting scenario is this: These two have a history - bad blood between them. Who knows why? Assume Shooter stole Attacker's wife or girlfriend.
Attacker shows up at Shooter's house at 530am with intent to engage in fisticuffs.
What then? I think in most states, Shooter would not be prosecuted. The Attacker was acting like a dangerous lunatic. Attacker may indeed have been a mentally unstable person in need of some psychiatric help. But, still, I think the law in most states would not prosecute the Shooter.
We can shoot an Attacker who is attacking with only his fists, in most states, I think.

I didn’t see this posted but this is part of the shooters statement:
quote:
I tell him to get down on the ground and to stop. And he just keeps approaching and I keep repeating that... The whole time I'm trying to give him verbal commands and he's threatening me and telling me to shoot him. And finally he reaches down, and from being his neighbor I knew he owned a Sig [pistol] in the past and a .40 Smith & Wesson and I thought he was going for his gun. We're very close... it's at that point I pull the trigger at the center of his chest and he just drops.

The Attacker might have been having some kind of psychotic event. Who knows? Still, I think that the laws of every state would see this situation as Self Defense.

i don't love the legal defense case.
not sure what instigated it all but i'm not sure his life was in danger and/or when you are shooting someone to defend your life, you don't stop shooting.
Sometimes, woke DA's will come after you because, "you shot him more than was needed so it wasn't necessary to save your life. You just wanted to kill him."

Similar situation happened in a parking garage in downtown Lexington not too long ago, except the guy defending himself didn’t have a gun. He died.
The overwhelming majority of people in this country have no clue how to fight or defend themselves no matter how many times they watched Roadhouse growing up. When shite hits the fan in real life, pull the trigger and don’t take any chances.
It's such a moronic take by the mouth breathers here who probably can't fight in real life. Every time you fist fight an unknown person, you're gambling your life. All it takes is one punch, just one time getting caught and you could be done for. It's an absurd amount of risk for no gain except your machismo ego.

I feel that if you're going to be aggressive and continue to move forward towards a guy with a gun pointed at you, you're too stupid to live.

When your life is endangered the idea is to stop the threat 100%. Unload the mag

I actually agree from my personal perspective. I also know, however, that bullshite like "was it reasonable" comes into the legal equation. To me, I don't even have an issue with security rounds but you walk a thin line when you unload on someone. I hate that that's the way it is in some blue areas with woke DA's because to me, I think if you decide to commit a violent felony against an innocent victim, I really don't care what happens to you. You made that choice, not the victim.
