All of the bolded portion is based on Stockley's testimony. There is no video/audio evidence of the gun in the vehicle, the struggle at the car, the actions of Smith, etc.
After reading the judge's decision, I've come to the conclusion that it is unlikely Stockley was acting in self defense, but proving his guilt beyond a reasonable doubt is difficult.

That's kind of my point. The judge erred on the side of Stockley with any hole the prosecutors had. I understand that's the way the system is supposed to work, but you certainly don't get the feeling that Stockely was innocent either.
