Wrong. I know prosecutors. More than half the time a state trooper will pull you over for passing the fog line. Dash cam footage shows it’s bullshite. Thrown out.

he is giving terrible advice. This is how you take a bad situation and put yourself in a situation that can potentially get out of hand (for the driver) super quick. In addition, do this, and possibly get arse whipped for "resisting" etc., and any good deal the driver could have made on his own goes out the window because of the other charges that will 100% be tacked on.

Best advice is if you going to drink and drive and get stopped, do not submit to any testing or make any statements and if that means you are arrested so be it (nobody gets forced to drink and drive, 100% a personal choice). They may take blood (warrant) either way, go see DA prior to court date and see what kind of deal they are prepared to make (they will talk to you) and if the driver feels like this is a bigger deal than he/she can negotiate, go talk to a lawyer with plenty experience in that particular jurisdiction

Yes, it is when you consider the alternative.

I’ve you’re even HALFWAY approaching .08, which isn’t that many beers, NEVER blow.

After 2 beers nobody needs to ever blow.

The inverse is WAY worse. You blow .08 in my state and the GOAT lawyer can’t get you out of it, literally. And the odds of getting these things dropped or whatever seems very high.


People should not blow if they’ve had much of any alcohol.

I completely get not blowing and not doing the sobriety test in the field. I’m not giving them any evidence to use against me there because at least I still have something to work with after the arrest. But my question is with refusal in the field, what are they actually arresting you for? Is it Suspicion until they do blood work and then they upgrade the charge and I’m guessing you aren’t getting out of blood work even if you have a lawyer present?

Yeah, I was arrested for suspicion.

I was able to turn down the blood test too here in Florida. Boy they were PISSED that I wouldn’t do it.

Everything was completely dropped less than a week later.

My friend's dad is an older attorney, very successful. He told us when we were teenagers that if we get caught drunk with a kilo of coke in our pants, to say you dont know anything about the alcohol or drugs...or just refuse to answer anything.

You are not resisting. Comply without getting out of the car to talk to them unless they are taking you to jail. Once you get out to plead your case they can say you are stumbling and slurring your words. Stay in the car and crack the window to talk to them. Get out to go to jail only.

once they tell you to get out and you dont or it takes longer than what they think it should take , that is when shite will get out of hand, especially if dealing with a short-fused hot head cop. WTF does cracking the window do...lol? They are going to tell the driver to roll the window down and when they dont...they will just break it and yank the driver out and add on the resisting charge to cover thier arse..there are literally thousands of videos online where you can watch this exact scenario over and over again..all im saying is that we have all seen examples of stuff that gets out of hand that didnt need to and the advice that this Glenn dud is giving, if followed, gives one a very good chance of being a part of a situation that gets out of hand , that didnt need to..Also, not every cop is going to bring every drunk they stop to jail, at least give yourself a chance..being combative will 100% remove that chance either way
