My friend is getting a divorce. His wife is withholding his service dog. I saw her at a store using it as her service dog complete with vest etc. She has no disabilities. I would love to get her arrested for this. Since she's being a huge bitch about the divorce.
I saw one in Publix and the person looked fine.

We go into Publix all the time. My son is not deaf or blind and he looks fine, but he still has a disability and his service dog has saved his life, literally.

Q7. What questions can a covered entity's employees ask to determine if a dog is a service animal?
A. In situations where it is not obvious that the dog is a service animal, staff may ask only two specific questions: (1) is the dog a service animal required because of a disability? and (2) what work or task has the dog been trained to perform? Staff are not allowed to request any documentation for the dog, require that the dog demonstrate its task, or inquire about the nature of the person's disability.

So, questions are allowed to be asked. What constitutes a disability worth of having a service animal? How can you prove I do not have a mental disability? If I am not required to demonstrate the animal's ability then asking the question is worthless.
My story: I have a mental disability that results in sudden outbursts of rage. My service animal responds by calming my rage. Now leave me alone or I will claim harassment.

You never know she might just have a therapist's prescription for the dog. You know, for all the trauma your buddy is causing her in the divorce. The only thing making life tolerable for her right now is knowing that she can steal your friend's dog, take it everywhere she freakin goes, and no one can challenge her about it

The ADA makes a distinction between psychiatric service animals and emotional support animals. If the dog has been trained to sense it is about to happen and take a specific action to help avoid the attack or lessen its impact, that would qualify as a service animal. However, if the dog's mere presence provides comfort, that would not be considered a service animal under the ADA.
It is very rare for a service dog to be trained to bark as a task. "Under control also means that a service animal should not be allowed to bark repeatedly in a lecture hall, theater, library, or other quiet place."
Even service dogs can be legally removed if they are not under control or housebroken. That is the balancing part of the law. It gives the benefit of the doubt to the person with a service dog being allowed in but gives the business the right to remove a service dog for behavior.
