2. shoot for the legs?? if you pull a gun, you do it to kill.

but im not pulling a gun on someone who is threatning me to fight bare fist. Only if im out numbered or they have a weopon. Rather thats a gun, kife, or a 2x4 or what have you

Do yourself a favor and go get some training on how to use your weapon, your current method will get you killed one day. There is no way in hell u can tell if he has a weapon or even if he has someone with him.Ole school fighting is long gone man get with the times or it may cost you dearly.

i didnt say i was fighting. But if im feeling a threat, and that threat is just mouthing off im backing away from the situation and removing myself. Im not going to immediately pull a gun. Because if you pull it you better be ready to use it. I dont want murder of a man that is upset because he thought his child was in danger on my conscience.

I would say that you should be glad you did not use deadly force because I am not sure if the man did enough to constitute imminent fear of death of serious bodily harm.

From your post, he did not have a weapon. You also never say he threatened to use physical force against you and he never actually touched you.

The question for a jury is whether a reasonable person under the same circumstances would have feared imminent danger to his life or serious bodily harm.

Here, was it imminent...yes

was the fear reasonable...yes

was is reasonable to fear death or serious bodily harm when the guy didnt threaten you and didnt have a weapon...i dont know what a jury would do

Keep in mind that the standard is NOT reasonably fears imminent bodily harm. Rather, its must be death or serious bodily harm.

I could see a jury going either way.

well from what the OP said there is high chance that boy will be in jail by then, considering the demographic.

Tough guys in here. Shoot to kill. Geez, you rednecks sure are trigger happy. Seriously, the guy almost got shot because he confronted you? Obviously, he wasn't that pissed because someone else yelled at him and he left.

Next time instead of grabbing for a shotgun why not try to de-escalate the situation? Hell, jump in the car and lock it.

Bottom line is, unless you see a gun/knife pointed at you or a guy actually makes contact, pulling a gun is pretty damn wussyish. You freaks are out of control.

Think about this - someone cuts you off in a parking lot. You park walk toward them headed toward a store and call them an a-hole. Dude shoots you because you walked his direction looking "threatening."

The itchy trigger fingers and gun obsession on this board is bizarre.
